Terms & Conditions
Effective 8 July 2026
The short version
Surge lets you pay event vendors even when the venue has no signal. You authorize a UPI Autopay mandate once; payments you make at an event are signed on your device and the money moves from your bank through our payment partner (Razorpay) when connectivity returns. We never hold your money, we don't do wallets or top-ups, and you can revoke the mandate from your UPI app at any time.
1. Who we are
Surge ("Surge", "we", "us") is operated by Aditya Singh, a sole proprietorship trading as Surge, based in Pune, Maharashtra 411021, India. You can reach us at hello@trysurge.in or +91 6282779318 — full details on the Contact page. Surge is currently pre-launch: parts of the service described here are available only to pilot participants we onboard directly.
2. What Surge is (and is not)
Surge is a technology platform that facilitates payments between event attendees and vendors at live events. All money movement is executed by Razorpay Software Pvt. Ltd., an RBI-authorised online payment aggregator. Surge never receives, holds, or pools your funds: attendee payments settle from your bank via your UPI Autopay mandate into Razorpay's escrow, and vendor settlements flow from that escrow to the vendor's verified bank account.
- Surge is not a bank, wallet, or prepaid instrument. There is no stored balance and no top-up.
- Surge is not the seller. Vendors sell you their goods and services; Surge moves the payment.
- Surge is not a lender. Nothing here is credit; every payment draws on your own bank account.
3. Eligibility
- You must be 18 or older and capable of entering a binding contract under Indian law.
- You need an Indian bank account with UPI enabled, and a mobile number registered with that account.
- Vendors and organizers must additionally complete onboarding (including bank verification by our payment partner) before receiving settlements.
4. How payments work
- Authorize once. You approve a UPI Autopay mandate with a spending cap you choose. Approving it involves a ₹1 verification charge as required by the UPI ecosystem.
- Pay offline. At an event, each payment you make is cryptographically signed on your device at the moment you confirm it. That signed record is the payment instruction — it cannot be altered, reused, or double-spent.
- Settle on reconnect. When connectivity returns, your signed payments are debited from your bank against your mandate, within the cap you set. UPI rules may require a pre-debit notification to you before a debit executes.
- Stay in control. You can view, pause, or revoke the mandate at any time from your UPI app. Revoking stops future debits; payments you already signed for goods you received remain owed to the vendor.
Offline spending is capped per payment and in total until settlement clears. We may adjust caps for safety, fraud prevention, or regulatory reasons.
5. Your responsibilities
- Keep your device and its lock secure — offline payments are signed by keys on your device, and anyone you hand an unlocked device to can pay with it.
- Provide accurate registration details (your phone number must be yours).
- Maintain sufficient balance in your bank account for payments you have signed.
- Use Surge only for lawful purchases at participating events.
- Do not attempt to tamper with, reverse-engineer, or defraud the payment flow. We revoke access for abuse and pursue recovery of amounts owed.
6. Vendors and organizers
Vendors receive settlements into their verified bank account via Razorpay's linked account infrastructure and must also accept Razorpay's applicable terms during onboarding. Vendors are responsible for the goods and services they sell, their pricing and menu accuracy, applicable taxes on their sales, and honouring sales confirmed through Surge. Organizers get event-level reporting; they do not gain access to individual attendees' personal data beyond what the recap requires.
7. Fees
Current fees are listed on the Pricing page. Attendees pay exactly the vendor's listed price — Surge adds no markup. Any future change to fees will be announced in advance and never applied retroactively.
8. Cancellations, refunds, disputes
Covered in the Cancellation & Refunds policy, which is part of these terms. For anything that looks wrong — a duplicate charge, a payment you don't recognise — contact us at hello@trysurge.in and we will investigate against the signed payment record.
9. Service availability
Surge is designed to work through connectivity failures, but we do not guarantee uninterrupted availability of the app, settlement timing by banks and UPI systems, or participation of any particular vendor or event. During the pre-launch period the service may change materially between pilots.
10. Liability
To the maximum extent permitted by law, our aggregate liability to you for any claim arising from the service is limited to the value of the disputed transaction(s) giving rise to the claim. We are not liable for the quality of vendor goods and services, for losses caused by your device being compromised while unlocked, or for delays caused by banks, NPCI, or other parties outside our control. Nothing in these terms limits liability that cannot be limited under Indian law.
11. Changes to these terms
We may update these terms as the product and regulations evolve. Material changes will be notified in the app or by the contact details you registered, with the effective date updated above. Continuing to use Surge after a change takes effect means you accept it.
12. Governing law
These terms are governed by the laws of India. Courts at Pune, India have exclusive jurisdiction, without limiting rights you hold as a consumer under applicable law.
